Coaching Agreement - Terms & Conditions
These terms and conditions form a part of Confident Future’s agreement with you and apply to your membership of the Confident Future Coaching Program (the “Program”), to the exclusion of all other terms and conditions issued or stipulated by anyone else other than Confident Future. ln these terms and conditions a reference to “us”,” our” and “we” mean Confident Future where in its own capacity or as agent of The Confident Future Trust.
1. Satisfaction Guarantee Term
lf you choose to cancel your membership of the Program, by submitting a written request within 30 days of the start of your membership, then you will receive a 100% refund of the amount you have paid for your membership- subject to paragraphs 2 and 3 below.
2. Eligibility for a refund upon cancellation within 30 days
lf you do not complete and return the Sure Start Questionnair or respond to your coach for your first coaching call you are not eligible for a refund.
lf you do not notify Confident Future in writing of any changes, you are not eligible for a refund. lf you do not utilise the Confident Future system (coaching calls, tele-classes or website) you are not eligible for a refund.
3. Canceling your membership
All requests to cancel your membership must be received by Confident Future in writing, by email (to info@confidentfuture.com.au or by fax to +61 8 6311 7378). Voicemails or verbal discussion do not constitute a written request. In the event of cancellation you will forfeit any bonus offers and be billed for any already received.
4. Term of membership
The Confident Future Coaching Program is a yearly (12 months) membership. Upon enrolling in this program, you must pay the first month’s membership fee and a commitment deposit equal to a months membership fee. The commitment deposit will be used as payment for the 12th month of your current membership term.
5. lf you resign your membership
lf you, for any reason, resign from the Confident Future Coaching Program and do not complete the 12 month term you are enrolled for, your commitment deposit will not be refunded nor applied towards another month - instead it will be used as an administration fee.
6. Membership renewal
At the end of each membership term (12 months), renewal of your membership is AUTOMATIC unless you have notified us in writing at least 5 business days before the end of the term.
7. Payment plans
Unless you have paid in full for your entire term of membership:
7.1 You agree to pay by automatic monthly billing to your nominated credit card or bank account. You will be charged on the anniversary date of your enrolment each month.
7.2 You are responsible for paying all monthly membership fees whether you participate in your scheduled coaching sessions or not.
7.3 A $25.00 administration fee will be charged to your account for each occurrence of a) Denied credit card authorisation and b) Late payments.
7.4 lf your account falls into arrears, your membership activity may be suspended until all fees have been paid.
7.5 lf you choose to resign your membership before the end of the term, your written resignation request must be received at least five (5) business days prior to the start of each new month or you will be billed for another month of membership.
8. Coaching calls
You understand that the Confident Future Coaching Program provides personal coaching services with a qualified and trained coach as well as online coaching materials. Unless otherwise specified, members receive the number
and duration of coaching calls shown when they subscribe. You may also purchase additional sessions per month. lf you miss any scheduled calls, there are no make up calls or refunds.
9. Email
The Confident Future Coaching Program is an email driven program therefore all members must have an individual email address (non shared).
10. No membership suspension
Once your membership is in progress, you will not be able to suspend your account temporarily during any part of the membership.
11. Call costs
Telephone calls with a coach during your membership are at the members’ expense. Coaches do not call our members.
12. Program changes
Confident Future reserves the right to change, modify or cancel the Program as Confident Futrure considers necessary.
13. Release
You agree to release Confident Future, The Confident Future Trust, all its agents and staff from any personal, physical injury or financial liability incurred at, or as a result of, this program. You understand that all action taken is performed voluntarily. Members should seek independent professional advice before undertaking any physical, business or investment actions.
14. Membership fees
You understand that all membership fees are non-refundable once the program is in progress after the 30-day Satisfaction Guarantee Period.
15. lntellectual property
All material relating to the Program is subject to copyright and other intellectual property rights. The copyright in all such materials remains the property of their owners and may not be recorded, used or reproduced without the written permission of the copyright owner.
You agree not, at any time, to do anything that would infringe the Intellectual property rights in such materials.
16. General
The laws of the state of Western Australia govern this agreement. Should any part of this agreement be determined by a court to be invalid or unenforceable, the remainder of the agreement will be unaffected. This agreement may not be varied except with the written approval of a director of Confident Future. All terms, conditions and warranties implied by statute that are excludable are excluded from this agreement. Such terms, conditions and warranties implied by statute that are not excludable are not excluded from this agreement but our liability for breach of such conditions and warranties implied by statute that are not excludable is limited to the total amount paid by you to Confident Future under this agreement.
